1. Introduction

These Terms and Conditions govern your use of the services provided by Danlau Pty Ltd (ABN 65 096 414 363), a pest control company operating in New South Wales, Australia. By booking or using our services, you agree to be bound by these Terms and Conditions.

2. Definitions
  • “We,” “us,” “our” refers to Danlau Pty Ltd.
  • “You” refers to the customer or client engaging our services.
  • “Services” refers to any pest control treatment or related service provided by us.
3. Booking and Payment
  • Booking Confirmation: All service bookings are subject to availability and will be confirmed by us either in writing or via phone/email.
  • Quotes: Any quotes provided are estimates based on the information available at the time of the inquiry. Final pricing may vary depending on the condition of your property or the severity of the pest infestation.
  • Payment Terms: Payment is required in full upon completion of the service unless otherwise agreed in writing. We accept payment via cash, credit card or direct debit.
  • Cancellation: If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Failure to do so may result in a cancellation fee of $99.00. We reserve the right to reschedule appointments due to unforeseen circumstances.
  • Access is not provided: Should access not be provided at the agreed time and re-attendance is required, a re-attendance fee of $99.00 may be charged to and be payable by the resident responsible for providing access.
4. Scope of Services
  • Services Provided: We will provide pest control treatments based on the type of infestation and the agreed plan. We will use our professional expertise to ensure the treatments are safe, effective, and environmentally responsible.
  • Service Limitations: While we strive to eliminate pests effectively, no pest control service can guarantee 100% pest eradication, as factors such as environment, property condition, and post-treatment care can affect outcomes.
  • Our Staff: Only control agents approved by the Department of Primary Industry and Energy’s Australian Pesticides & Veterinary Medicines Authority (APVMA) and registered for use in the relevant State or Territory or in accord with a Permit issued by APVMA or State Authority will be used.
  • Cancellation: If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Failure to do so may result in a cancellation fee of $99.00. We reserve the right to reschedule appointments due to unforeseen circumstances.
  • Customer Responsibilities: You must advise us of any pets or of any personal or family/staff allergies, or other concerns. You must ensure that all areas requiring treatment are accessible and free from obstruction and pets and children should be kept away from treated areas as instructed by our technicians. You must provide accurate and complete information regarding the pest issue. You must grant us access to your premises at the agreed time for the performance of our services. You must cover all food items and all food utensils. You must avoid contact with treated surfaces until the control agent has dried. You must observe any pre-treatment advice and verbal advice provided by our firm or our licensed operator at the time of treatment. You must ensure your premises are properly ventilated after treatment. Leave any air-conditioners on ‘vent mode’ (so they circulate outside air into the building) for a period of at least four hours after the treatment or after re-occupying.
  • Water Tanks: No treatment can be carried out around water tanks not fully sealed or to water collection areas. You must advise us of water tanks installations.
5. Warranties and Guarantees
  • Service Warranty: We offer warranties on some services (e.g., termite treatments), which will be outlined at the time of booking. Specific warranty periods and conditions will depend on the type of service provided. While we take every precaution to ensure effective pest control, we do not guarantee the complete removal of pests. Success may vary based on factors beyond our control. Our liability for any claim arising from our services is limited to the total amount paid by you for the service. We are not liable for any indirect, incidental, or consequential damages arising from the provision of our services.
  • Exclusions: Warranties do not apply if our recommendations for post-treatment care are not followed or if new pest infestations occur from external sources.
  • No responsibility is accepted, or warranty implied, for any damage or consequential losses that may occur as the result of past, current or future pest activity.
6. Health and Safety
  • Safety Precautions: We use approved pest control products that comply with Australian health and safety regulations. However, you must follow any safety instructions provided by our technicians to minimize risks to your household, pets, and property.
  • Pre-existing Conditions: We are not responsible for any damage caused by pests that were present prior to our treatment, or any structural issues that existed before our service.
7. Limitation of Liability
  • Property Damage: We will take all reasonable precautions to avoid damage during our services. However, we are not liable for any staining of timbers, fabrics, wall coverings, floor coverings or of any other articles that may occur. We are also not liable for any pre-existing conditions or concealed damages that may be exacerbated by the treatment.
  • Pest Re-infestation: We are not responsible for pest re-infestations that occur due to environmental factors, neglect, or failure to maintain the recommended prevention measures.
  • Indirect Damages: To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages resulting from the use of our services.
  • WARNING: Where drilling and or cutting is required; no liability is accepted should damage result to concealed services such as power, gas, water, etc. You indemnify Us against any costs that may arise from such possible damages. Clear and accurate plans should be provided by you before we commence.
8. Termination of Services

We reserve the right to terminate our services if:

  • You fail to comply with these Terms and Conditions.
  • We are unable to access the property at the agreed time without prior notice.
  • We determine that the pest infestation poses a significant health or safety risk.
9. Dispute Resolution

If you are dissatisfied with our services, please contact us immediately to discuss your concerns. We will make every effort to resolve any issues promptly and professionally. If a resolution cannot be reached, the dispute will be referred to mediation before pursuing any legal action.

10. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms and Conditions or our services will be subject to the jurisdiction of the courts in New South Wales.

11. Amendments

We reserve the right to update or amend these Terms and Conditions at any time. Any changes will be posted on our website and will take effect immediately.
